The Culver Theater Website Terms of Use

PLEASE READ THIS TERMS OF USE (“AGREEMENT”) CAREFULLY. BY VISITING OR USING THIS WEBSITE (THE "SITE"), YOU ACKNOWLEDGE YOU HAVE READ THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.

This Agreement sets forth the terms of use for the website operated by Amazon.com, Inc., its parent, subsidiary, affiliated companies, licensees, assigns and/or its contractors (collectively “Amazon") at www.theculvertheater.com, and other websites and applications owned or operated by or on behalf of Amazon related thereto. Amazon reserves the right to make changes to the Site, policies, and this Agreement at any time. If Amazon makes material changes to this Agreement, we shall provide appropriate notice under the circumstances, which may include displaying notice within the Site or by email to your registered email address.  Your continued use of the Site after such notice shall be deemed to constitute acceptance of such changes.

THEATER RULES AND COVID ACKNOWLEDGEMENT

By purchasing a ticket to attend and/or attending an event in-person, you do so voluntarily and agree to assume all risk associated with attending the event, including, without limitation, potential exposure to COVID-19 and variants thereof, to the fullest extent permitted by applicable law. You also agree to release, indemnify and hold Amazon harmless against all suits, claims, actions, and complaints of every nature, including attorneys’ fees and costs relating to any claims brought by you or any third party on your behalf or in any way related to you. You also agree to comply with all applicable federal, state, and local laws, orders, and guidance, as well as the theater’s rules and all directions of management while at the theater, including, without limitation, those pertaining to COVID-19 health and safety. Failure to comply with any theater rules and/or policies will result in removal from the event with NO refund.

CONVENIENCE FEES

You may purchase tickets prior to the showing in person at the box office or online at the Site or Atomtickets at https://www.atomtickets.com/. By using or otherwise interacting with the Atomtickets website, you agree to be bound by all terms of use and privacy policies applicable to their website.

A non-refundable convenience fee (“Convenience Fee”) will be payable when purchasing tickets online through the  Site, other Culver Theater websites or mobile apps.  This Convenience Fee is charged in addition to the ticket price and the amount of the Convenience Fee will be displayed during the online ticket purchase process. You may purchase tickets at the theatre in person if you would prefer not to pay the Convenience Fee. By booking your ticket online, you agree to pay the Convenience Fee in addition to the price payable for tickets. Convenience Fee may vary by ticket type.

 

 

USER SUBMISSIONS

You and other users of the Site may post comments, reviews, and other content and information, provided the content does not contain any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful content or content which is otherwise objectionable or infringes upon the rights of any third party. You agree not to impersonate any person and/or other entity or communicate under a false name. Amazon has the right but not the obligation to remove, prohibit, edit or discontinue any content on the Site, including content that has been posted by you.

We do not to accept or consider creative materials, ideas, or suggestions other than those we specifically request in writing in order to avoid misunderstandings if your ideas are similar to those we independently developed. Please do not send to us any original creative materials such as scripts, ideas, artwork, etc.  Any such communication or material you transmit to the Site electronically or otherwise shall be treated as non-confidential and non-proprietary. Anything you transmit or post may be used by Amazon or its affiliates for any purpose, including, without limitation, reproduction, disclosure, transmission, publication, broadcast, developing, manufacturing and marketing using such information.

ASSIGNMENT

You may not assign, delegate or transfer this Agreement or any of your rights hereunder, and any attempt to do so will be null and void.

TERMINATION

Amazon may in its sole discretion, to terminate your access to all or part of the Site, with or without notice, for any reason or no reason, including without limitation your violation of this Agreement. The terms and conditions of this Agreement which by their nature reasonably should survive termination of this Agreement shall survive any termination of this Agreement.

ELECTRONIC COMMUNICATIONS

When you visit the Site or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

COPYRIGHT

All content included on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Amazon or its content suppliers and protected by United States and international copyright laws. The compilation of all content on the Site is the exclusive property of Amazon and protected by U.S. and international copyright laws. All software used on the Site is the property of Amazon or its software suppliers and protected by United States and international copyright laws.

TRADEMARKS

CULVERTHEATRE.COM, THECULVERTHEATRE.COM, theculvertheater.com, CULVERTHEATER.COM, and other Site graphics, logos, page headers, button icons, scripts, and service names are trademarks, registered trademarks or trade dress of Amazon in the U.S. and/or other countries. Amazon's trademarks and trade dress may not be used in connection with any product or service that is not Amazon's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Amazon. All other trademarks not owned by Amazon that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Amazon.

LICENSE AND SITE ACCESS

Amazon grants you a limited license to access and make personal use of the Site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Amazon. DISPUTES

Any dispute or claim between you and Amazon relating in any way to your visit to the Site or to properties contributed to, developed on or distributed by or through the Site will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms of Use as a court would.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent Corporation Service Company, 300 Deschutes Way SW, Suite 304, Tumwater, WA 98051. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. We will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise, Amazon will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

APPLICABLE LAW

By visiting the Site, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Washington, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and Amazon.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other agreements, rules and notices posted on the Site. These policies also govern your visit to the Site. We reserve the right to make changes to our Site, policies, and these Terms of Use at any time. If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

FREQUENTLY ASKED QUESTIONS

  • How can I get a refund? All refund requests must be made prior to the showing at the box office (any request received after the show cannot be accommodated).
  • Why am I restricted from purchasing seats designated for companions of persons using wheelchairs? We have a legal obligation to ensure our wheelchair accessible seating and companion seating is made available up until 10 minutes prior to show time in every screening room. Our staff is instructed to keep such seats available up until 10 minutes prior to the film starting before allowing sale of the same to the general public.
  • Do you have equipment to assist hard of hearing or visually impaired guests? The theater offers several options to provide a quality entertainment experience for our deaf, hard of hearing and vision impaired guests. Please ask the box office attendant about amenities available for your specific film when purchasing your tickets.
  • What are film ratings and what is the admittance policy? The Motion Picture Association of America (“MPAA”) assigns rating to films in order to provide a general guideline to audiences about content appropriateness. For additional information about the voluntary movie rating system and ratings for new releases, visit the MPPA home page at http://www.mpaa.org.
